The jury in the first federal retrial have found for Merck.
They deliberated for just 3 hours and 40 minutes, the shortest period of any of the four juries yet in Vioxx-related cases.
Good news?
Certainly for some, at Merck, but not necessarily for all.
Merck face more than 9,600 state and federal lawsuits.
Judge Fallon has been assigned to handle pretrial matters for all 4,000-plus federal cases, and has told attorneys he hopes to work out a settlement after the first four are tried.
