Jurors were deadlocked late on Wednesday over whether Wyeth's hormone replacement drug Prempro caused a 67-year-old woman's breast cancer, but the judge in the trial ordered them to return on Thursday to attempt to reach a verdict.
"Right now, there's an impasse," said Judge Norman Ackerman of the Philadelphia Court of Common Pleas, which is hearing the first state court trial among some 5,000 lawsuits filed against the company over the hormone replacement therapy (HRT).
Following some 10 hours of deliberations over two days, the jury of five men and three women were sent home by Ackerman with instructions to return to court at 9 am (EDT) to resume their efforts to decide the case.
"It's important for all parties that the jury can appropriately reach a verdict," Ackerman said.
Jennie Nelson of Dayton, Ohio blames Prempro, which she took for about six years, for her breast cancer.
