Pfizer - Rezulin: call the first witness

Poor Pfizer. The world's biggest drugmaker, must now defend a lawsuit in which people claim its diabetes drug Rezulin (troglitazone) damaged livers.

The federal appeals court in New York today reinstated a case dismissed last year by a lower-court judge. The judge said New York-based Pfizer was shielded from the suit by state law in Michigan, whose law will be applied.

The plaintiffs in this case live in Michigan.

The appeals court reversed the trial judge.

"It has long fallen within the province of states to safeguard the health and safety of their citizens,'' the appeals court said.

Consumers across the country have sued Warner-Lambert, which has since been acquired by Pfizer, saying the company sold Rezulin knowing it caused liver damage in some users.
