Attorneys for Lawrence Appell, 56, and Rudolph Arrigale, 77, today accused Merck, the fourth-largest U.S. drugmaker, of failing to disclose known dangers of the medicine, as a trial started in Los Angeles.
It is the second California trial over claims the now-withdrawn painkiller caused heart attacks.
"Without Vioxx, it's unlikely that Mr. Arrigale would have had a heart attack,'' lawyer Thomas Brandi said in his opening statement. "If Merck simply had told the truth and the whole truth about Vioxx, we wouldn't be here today.''
