Preemption - quote of the week

The Supreme Court decision may cost the pharma industry “billions of dollars,” said attorney Mark Herrmann at Jones Day in Chicago, who defends companies in similar suits. “There’s no way to quantify it, but the number has as many zeroes in it as attacked Pearl Harbor.”

Said in the vain of the father of FDA Preemption Dan Troy who once said – "We have to pick our shots…so make it sound like a Hollywood pitch." Or to further paraphrase – Don’t let the facts stand in your way.

Billions of dollars?

Mark may have been hit in the head with something that dropped out of one of those zeroes.

For a few years before the Levine verdict, the defense law lobby was able to convince plaintiffs to accept lousy settlements with the expectation that Wyeth would prevail. They called it "the Wyeth discount."

So whatever comes in now is, in effect, making up for what the defense gang extorted earlier.
