Merck trial - the jury is out

The jury are now considering in the second Merck Vioxx trial. The plaintiffs lawyer Chris Seeger called Merck a "monster" and compared its defense in the seven-week trial to an octopus that squirts ink at its enemies to muddy the water.

The six-woman, three-man panel will try to decide whether Merck knowingly misrepresented the safety risks posed by its blockbuster arthritis drug and whether Vioxx contributed to the heart attack suffered by Frederick "Mike" Humeston.
